How did this happen?

Builder’s Remedy is being used to circumvent existing zoning requirements to gain project approval. Builder’s Remedy comes into effect when the local jurisdiction (Santa Clara County) doesn’t have an approved housing element. This law allows developers to build virtually anything they want without needing to worry about current zoning laws. In this case, the developer purchased this lot and has submitted an application to construct 10 three story townhomes in our quiet neighborhood.

Currently developers can buy up properties in our neighborhoods and build virtually anything they want without adhering to zoning rules. They want to maximize their profits and leave our neighborhoods behind to deal with the repercussions.

Traffic and Parking

Stacking high density housing with inadequate parking in an elbow cul-de-sac drastically increases the amount of traffic in these streets as well as on Wyrick Ave. Not to mention none of these streets have sidewalks, making increased traffic an even higher danger to pedestrians.

Property Values

These townhomes are 3 stories and over 38ft tall. In a neighborhood with only a handful of 2 story houses, these townhomes will dominate the views. This combined with the fact that townhomes cause neighborhood depreciation will cause your property values to drop.

Ask our governor to veto AB1893

AB1893 allows developers to bypass low income housing requirements if they stack enough units on the lot.

  • Select Request for Help and select Next
  • Change the Message subject to “VETO AB1893”

Watch Home Sales In Your Neighborhood

Until Santa Clara County has an approved Housing Element, developers can continue to purchase lots in our neighborhood and use Builder’s Remedy to construct townhomes. Keep an eye on home sales and see if you can work with the owners to prevent sales to developers intending to build townhomes.
